GENERAL TERMS AND CONDITIONS OF SALE
1. THE SELLER
The products offered on this website are sold by TEK DOGWEAR S.R.L., registered office at Via Caravaggio 2/B, 20832 Desio (MB), Italy, operating office at Via delle Fontanelle 6, 22044 Inverigo (CO), Italy. VAT and Tax Code 14805410967, registered with the Companies Register of Milano Monza Brianza Lodi, REA no. MB-2808029, share capital EUR 10,000.00. 2. SCOPE
These terms govern the distance selling of products through this website. By placing an order you confirm that you have read and accepted these terms.
Sales to resellers and trade customers are governed by separate terms.
3. PRODUCTS AND PRICES
Prices are shown in the currency of the market you are shopping in: euro for Italy, the European Union and most other destinations; Swiss francs, British pounds, US dollars, Canadian dollars, Swedish, Norwegian and Danish kroner for those countries. You pay the price shown, in that currency. Your card issuer may apply its own exchange fees, over which we have no control.
For destinations within the European Union the price shown includes VAT. For destinations outside the European Union the price shown is the full amount payable to us for the goods: no Italian VAT is charged on exports and no VAT is deducted from the displayed price. Import duties, local taxes and customs handling fees of the destination country are not included and are payable by the customer, as set out in our Shipping Policy.
Shipping costs, where applicable, are shown separately before you complete your order.
Product images and descriptions are for illustrative purposes. Slight colour differences may depend on your screen settings.
We reserve the right to change prices at any time. The price that applies is the one displayed when you submit your order.
4. FORMATION OF THE CONTRACT
The contract is concluded when you receive our order confirmation email.
We reserve the right not to accept an order where the product is unavailable, where there is a manifest pricing error, where we cannot ship to the requested destination, or where we suspect fraudulent use. In such cases we will inform you promptly and refund in full any amount already paid.
5. AVAILABILITY AND PRE-ORDERS
Products are sold while stocks last. If an ordered product becomes unavailable after confirmation, we will contact you to offer an alternative or to arrange a refund.
Products marked "Pre-order" are not yet in stock. The expected shipping date is stated on the product page and in the cart before you order, and payment is taken when you place the order. If the shipping date changes we will tell you by email; if the delay exceeds 30 days from the announced date, you may cancel the order and obtain a full refund.
6. PAYMENT
We accept credit and debit cards and the payment methods shown at checkout. Payment is taken at the time of the order.
Payment details are processed directly by the payment service provider and neither pass through nor are stored on our systems.
7. INVOICING
For online purchases by consumers we do not issue an invoice unless it is requested.
Businesses: enter your company name and VAT number in the fields provided at checkout and we will issue an invoice for the order. Consumers resident in Italy who need an invoice: write to administration@tekdogwear.com with your order number and tax code on the same day you place the order. An invoice cannot be issued for an order after that.
8. SHIPPING AND DELIVERY
Please refer to our Shipping Policy, which forms an integral part of these terms. We ask you in particular to read the section on duties and taxes for destinations outside the European Union.
Delivery takes place within 30 days of the conclusion of the contract, except for pre-order products, which are delivered after the shipping date stated before purchase, and unless otherwise agreed.
The risk of loss or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.
9. RIGHT OF WITHDRAWAL AND SIZE EXCHANGE
Please refer to our Returns and Refunds Policy, which forms an integral part of these terms.
10. LEGAL GUARANTEE OF CONFORMITY
All products are covered by the legal guarantee of conformity provided for under European law, lasting two years from delivery.
In the event of a lack of conformity you are entitled to have the goods brought into conformity by repair or replacement, or alternatively to a price reduction or to termination of the contract.
To make a claim under the guarantee, write to claims@tekdogwear.com enclosing proof of purchase and photographs of the defect.
11. USE OF THE PRODUCTS
Our products are intended for use on domestic animals. Please check the correct size and proper use by consulting the guides available on this website.
We accept no liability for damage arising from improper use, incorrect sizing or failure to follow the instructions provided. Always supervise your animal while it is wearing our products.
12. COMPLIANCE WITH LOCAL REGULATIONS
Our products are manufactured in accordance with European regulations. It is your responsibility to check that the import and use of the products are permitted in your country.
13. INTELLECTUAL PROPERTY
All content on this website, including trademarks, images, text and graphics, is owned by TEK DOGWEAR S.R.L. or used under licence. Reproduction without written authorisation is prohibited.
14. GOVERNING LAW AND JURISDICTION
The contract is governed by Italian law.
For disputes with consumers resident in the European Union, the court of the consumer's place of residence or domicile has jurisdiction. Mandatory consumer protection provisions under the law of the consumer's country of residence remain unaffected.
For disputes with non-consumers, the Court of Monza has exclusive jurisdiction.
15. COMPLAINTS AND DISPUTE RESOLUTION
You may submit a complaint by writing to claims@tekdogwear.com. We aim to respond within 15 days.
If we are unable to reach an agreement, as a consumer you may turn to the mediation and alternative dispute resolution (ADR) bodies listed by the Italian Ministry of Justice and the competent authorities, including the mediation bodies of the Chambers of Commerce.
If you reside in another European Union country, you may seek assistance from the European Consumer Centre in your country.
Your right to bring proceedings before the competent court is always preserved.
16. CHANGES
We reserve the right to amend these terms. The terms that apply are those in force at the time your order is submitted.
