PRIVACY POLICY — HOW WE PROCESS YOUR PERSONAL DATA

We have not appointed a Data Protection Officer, as this is not mandatory in our case. For any question about your data you can write to administration@tekdogwear.com.

2. WHAT DATA WE PROCESS

Data you give us

  • Identification and contact details: first name, last name, shipping and billing address, email address, telephone number
  • Tax details, if you request an invoice: company name, VAT number or tax code, SDI recipient code or PEC address
  • Account details, if you create an account: login credentials, preferences, saved addresses
  • The content of the communications you send us: support requests, complaints, return requests

Data collected automatically

  • Browsing data: IP address, browser and device type, pages visited, products viewed, length of the visit
  • Data collected through cookies and similar technologies, as described in our Cookie Policy and according to the choices you make in the cookie banner

Payment data
Your card details do not pass through our systems and are not stored by us. They are processed directly by the payment service provider. We only receive the outcome of the transaction, the last four digits of the card and the card type.

3. WHY WE PROCESS YOUR DATA AND ON WHAT LEGAL BASIS

To perform the contract of sale — to manage your order, collect payment, ship the goods, handle returns, refunds and warranty claims, and answer your questions about the order.
Legal basis: performance of a contract (art. 6.1.b GDPR). Providing these data is necessary: without them we cannot complete the sale.

To comply with legal obligations — issuing and keeping tax documents, keeping accounting records, customs obligations for shipments outside the European Union.
Legal basis: legal obligation (art. 6.1.c GDPR).

To send you marketing communications — newsletter, news and promotions, if you subscribe.
Legal basis: your consent (art. 6.1.a GDPR), which you confirm by clicking the link in the verification email. You can withdraw it at any time through the unsubscribe link in every message, without affecting the lawfulness of processing carried out before withdrawal.

For analytics, personalisation and advertising based on cookies — browsing statistics, campaign measurement, personalised ads.
Legal basis: your consent given through the cookie banner (art. 6.1.a GDPR). You can change it at any time in the cookie preferences.

To prevent fraud and protect the website — checking suspicious transactions, system security.
Legal basis: our legitimate interest in protecting the company and its customers from fraudulent use (art. 6.1.f GDPR).

To defend our rights — handling disputes, complaints and litigation.
Legal basis: our legitimate interest in protecting our rights in and out of court (art. 6.1.f GDPR).

4. WHO WE SHARE YOUR DATA WITH

Your data are accessible to the company's authorised staff and are disclosed to the providers whose services are necessary for the sale. The main ones are:

  • Shopify International Ltd. — the platform the store runs on, hosting, order and account management. European Union, with possible transfers outside the EU
  • Shopify Payments and payment providers — collection and verification of payments, fraud prevention. European Union, with possible transfers outside the EU
  • DHL Express and our shipping software provider (ShippyPro) — label creation, parcel delivery, returns handling, customs formalities. European Union and destination countries
  • TeamSystem S.p.A. (Fatture in Cloud) — electronic invoicing, accounting, legally compliant archiving. Italy
  • Italian Revenue Agency, Sistema di Interscambio — receipt of mandatory electronic invoices. Italy
  • Our tax advisor — accounting and tax compliance. Italy

Some of these parties act as data processors, appointed under art. 28 GDPR.

Please also note that Shopify, as the platform provider, uses data about interactions with our store — together with data from other stores using the same platform — to improve its services, payment security and ad personalisation. For this processing Shopify acts as an independent controller: you can find the relevant information and the channels for exercising your rights in Shopify's privacy policy at privacy.shopify.com.

Your data are not sold to third parties.

Finally, your data may be disclosed to public authorities where required by law, and to legal advisors in the event of a dispute.

5. TRANSFERS OUTSIDE THE EUROPEAN UNION

The store's data are hosted on servers located in the European Union.

Some providers may nevertheless process data in third countries. In such cases the transfer takes place only if the country is covered by an adequacy decision of the European Commission, or on the basis of the Standard Contractual Clauses approved by the Commission, together with any additional safeguards required.

If you order from a country outside the European Union, your shipping details are transmitted to the customs authorities of the destination country: this is a legal obligation linked to export.

6. HOW LONG WE KEEP YOUR DATA

  • Order data and tax documents: 10 years from the date of the document, as required by art. 2220 of the Italian Civil Code and by tax law
  • Account data: for as long as you keep the account active. If it remains unused for 24 months we close it, except for the data we are required to keep by law
  • Newsletter data: until you withdraw your consent, and in any case no longer than 24 months after your last interaction
  • Browsing data and cookies: for the periods indicated in the Cookie Policy
  • Support communications: 24 months after the request is closed
  • Data needed to defend a right: until the limitation period for the claim expires

Once these periods expire the data are deleted or irreversibly anonymised.

7. YOUR RIGHTS

You may at any time ask us to:

  • Access your data and obtain a copy (art. 15)
  • Rectify inaccurate or incomplete data (art. 16)
  • Erase your data, where we have no obligation to keep them (art. 17)
  • Restrict processing in certain cases (art. 18)
  • Receive your data in a structured format and transfer them to another controller (art. 20)
  • Object to processing based on legitimate interest (art. 21)
  • Withdraw your consent at any time, for processing based on it

To exercise these rights write to administration@tekdogwear.com. We reply within one month; this period may be extended by two months for particularly complex requests, in which case we will let you know. We may ask you to verify your identity before proceeding. Exercising your rights is free of charge, except for manifestly unfounded or repetitive requests.

8. COMPLAINTS

If you believe that the processing of your data infringes the law, you may lodge a complaint with the supervisory authority.

9. CHILDREN

Our services are not intended for children under 16 and we do not knowingly collect their data. If you are a parent or guardian and believe that a child has provided us with personal data, write to administration@tekdogwear.com: we will delete them.

10. AUTOMATED DECISION-MAKING

We do not take decisions based solely on automated processing that produce legal effects concerning you. The payment provider's anti-fraud systems may flag a transaction as suspicious, but the final decision on an order is always taken by a person.

11. COOKIES

The use of cookies and similar technologies is described in our Cookie Policy. You can change your choices at any time from the cookie preferences panel.

12. CHANGES

We may update this policy, for example when we add a new service provider. The current version is always published on this page, with the date of the last update.
